These Terms of Use (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to these Terms and to our Privacy Policy, if posted on the Site. If you do not agree, please do not use the Site.

The Site is not directed to children under 13.

We work to present information carefully and accurately, but we do not guarantee that all descriptions, images, ingredient details, allergen information, pricing, specifications, availability, or other content will always be complete, current, or error-free.

From time to time, product packaging, ingredients, nutritional information, availability, and presentation may change without notice. Images and videos on the Site are for general illustrative and brand presentation purposes and may not reflect every current detail of a particular product, box, label, or offering.

Consumers should always review the actual product packaging, ingredient panel, allergen statement, storage instructions, and labeling before consuming or using any product. If there is any difference between information shown on the Site and information on the physical product packaging, the physical product packaging controls.

Mochi Bloom products may contain or come into contact with allergens, including but not limited to milk, soy, nuts, or other ingredients depending on the product. The Site is provided for general informational purposes only and does not provide medical advice, nutritional counseling, allergy diagnosis, or other health advice.

If you have food allergies, dietary restrictions, medical conditions, or other health-related concerns, you should consult an appropriate qualified professional and carefully review the actual product packaging before consumption.

  1. Orders, Purchases, and Additional Terms

If the Site offers shopping, checkout, subscriptions, promotions, discount codes, shipping options, or other transactional features, additional terms may apply. Those additional terms may address matters such as pricing, payment, shipping, returns, cancellations, availability, promotions, and order acceptance, and are incorporated into these Terms to the extent applicable.

We reserve the right to refuse, limit, cancel, or correct any order, promotion, or transaction at any time and for any lawful reason, including suspected fraud, inaccurate pricing, product unavailability, inventory issues, or violations of these Terms.

  1. Business, Wholesale, and Partnership Inquiries

You further represent and warrant that your Submissions do not violate any law or infringe the rights of any third party and are not fraudulent, misleading, defamatory, obscene, or otherwise unlawful.

We may, but are not required to, monitor, review, remove, or decline any Submissions in our sole discretion.

The Site and all content and materials made available on or through it are owned by or licensed to Mochi Bloom LLC, its affiliates, licensors, content providers, or other respective owners and are protected by applicable copyright, trademark, trade dress, and other intellectual property and proprietary rights laws.

  • all photographs, images, videos, graphics, illustrations, designs, layouts, page elements, and visual content;
  • all logos, trademarks, service marks, trade names, brand identifiers, and slogans;
  • all product packaging, packaging designs, box artwork, labels, product presentation, and overall brand look and feel;
  • all downloadable materials, promotional content, marketing assets, and creative materials; and
  • the selection, arrangement, and overall presentation of the Site and its contents.

Mochi Bloom, related names, logos, product names, packaging presentation, and other brand elements are valuable intellectual property owned by or licensed to Mochi Bloom LLC. Except as expressly allowed by these Terms or by applicable law, no part of the Site, packaging, box design, artwork, videos, images, text, or other content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, modified, displayed, sold, licensed, or otherwise exploited without Mochi Bloom’s prior written consent.

No right, title, or interest in or to any Site content or materials is transferred to you by your use of the Site.

WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE AT ALL TIMES OR THAT IT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, COMPLETE, ACCURATE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCHI BLOOM LLC AND ITS AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY CONTENT, MATERIALS, OR SERVICES PROVIDED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MOCHI BLOOM FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Mochi Bloom LLC and its affiliates, owners, members, managers, officers, employees, contractors, licensors, service providers, and agents from and against any claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys’ fees, arising out of or relating to:

  • your use of the Site;
  • your violation of these Terms;
  • your violation of any law or the rights of any third party; or
  • your Submissions.
  1. Suspension or Termination

We reserve the right, in our sole discretion and without notice, to suspend, restrict, or terminate your access to all or any part of the Site at any time for any reason, including if we believe you have violated these Terms or applicable law.

  1. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Site are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

To the fullest extent permitted by law, any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction and venue of those courts.

  1. No Waiver and Severability

If we do not enforce any provision of these Terms, that does not waive our right to do so later. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

  1. Entire Agreement

These Terms, together with any applicable Privacy Policy and any additional terms properly posted on the Site, constitute the entire agreement between you and Mochi Bloom regarding the Site and supersede all prior or contemporaneous communications regarding the Site.
